3. Pricing and Payment

3.1 Additional charges may apply for rush orders, special materials, or custom modifications beyond standard options.

 

4. Order Processing

4.1 Orders are processed upon receipt of full payment and design approval (for custom orders).

4.2 We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, design feasibility, or suspected fraudulent activity.

4.3 Custom orders may not be canceled once production has commenced.

 

5. Shipping and Delivery

5.1 Delivery times are estimates and may vary based on location, product type, and customization requirements.

5.2 Shipping costs are calculated at checkout based on destination, weight, and dimensions.

5.3 International shipments may be subject to import duties, taxes, and customs charges, which are the sole responsibility of the customer.

5.4 We are not liable for delays caused by customs authorities, natural disasters, or other circumstances beyond our control.

5.5 Delivery requires a signature upon receipt. Customers should inspect deliveries immediately and report any damage within 48 hours.

 

6. Returns and Refunds

6.1 Due to the custom nature of our Products, returns are only accepted for:

   - Products damaged during shipping (with proper documentation)

   - Products with manufacturing defects

   - Incorrect items shipped

 

6.2 Claims for damaged or defective Products must be made within 48 hours of delivery with photographic evidence.

6.3 Custom Products that do not meet the approved design specifications may be eligible for repair, replacement, or partial refund at our discretion.

6.4 Refunds will be processed using the original payment method within 14 business days of approval.

 

7. Intellectual Property

7.1 All content on our website, including designs, images, text, and logos, is our intellectual property and protected by copyright laws.

7.2 Customers grant us a license to use any provided images, text, or designs for the purpose of creating their custom Products.

7.3 Customers warrant that any materials provided do not infringe on third-party intellectual property rights.

 

8. User Responsibilities

8.1 Customers must provide accurate information for all orders, including delivery details and design specifications.

8.2 Customers are responsible for ensuring that all designs and inscriptions comply with cemetery regulations and local laws.

8.3 Customers acknowledge that headstone installation is typically performed by cemetery personnel or licensed professionals and is not included in our services unless explicitly stated.

 

9. Disclaimer of Warranties

9.1 Our Products are provided "as is" without warranties of any kind, express or implied, except as required by law.

9.2 We do not warrant that Products will meet cemetery requirements, as these vary by location. 

 

10. Limitation of Liability

10.1 Our total liability for any claim arising from or related to these Terms or our Products shall not exceed the purchase price of the specific Product involved.

10.2 We shall not be liable for indirect, incidental, consequential, or special damages, including but not limited to loss of use, loss of profits, or delays in delivery.

 

11. Changes to Terms

11.1 We reserve the right to modify these Terms at any time. Changes will be posted on our website with the effective date.

11.2 Continued use of our services after changes constitute acceptance of the revised Terms.
